Platform Terms of Use
The Tawana platform, accessible at https://www.tawana.shop/, including all subdomains (e.g. yourshop.tawana.shop), applications, APIs, and related services (collectively, the “Platform”), is operated by Tawana Commerce Ltd (“Tawana”, “we”, “us”, or “our”).

These Terms govern your access to and use of the Platform. Additional terms may apply depending on your role (e.g. Merchant Terms, Customer Terms, Payment Terms).

By accessing or using the Platform, you agree to be bound by these Terms.

You must be at least 13 years old to use the Platform.

1. Nature of the Platform
Tawana is a technology platform that enables merchants to create online shops, manage products, and sell directly to customers.

Tawana does not own, stock, or sell products listed by merchants
Tawana is not the seller of record unless explicitly stated
Tawana does not control fulfilment, delivery, or returns
Each merchant operates independently

Tawana provides infrastructure, including storefronts, order management, payments integration, analytics, automation tools, and third-party integrations.

2. User Roles
Users of the Platform may act as:

Customers — browsing shops and placing orders
Merchants — operating shops and selling products

Users may act in both roles. Additional obligations may apply depending on your role.

3. Accounts and Security
You agree to:

Provide accurate and complete information
Maintain the confidentiality of your login credentials
Be responsible for all activity under your account

Tawana may suspend, restrict, or terminate accounts where necessary to:

Protect users or the Platform
Prevent fraud or abuse
Comply with legal obligations

4. Merchant Responsibilities
If you operate as a Merchant, you are solely responsible for:

Product listings, pricing, and accuracy
Inventory management
Order fulfilment and delivery
Returns, refunds, and customer support
Compliance with applicable laws (consumer protection, tax, etc.)

You must not list or sell prohibited, illegal, or restricted goods.

Tawana may remove listings or suspend shops that violate these Terms.

5. Customer Responsibilities
If you use the Platform as a Customer, you agree to:

Provide accurate order and contact information
Use the Platform lawfully
Respect merchant terms (e.g. delivery timelines, return policies)

All purchases are made directly between you and the Merchant.

6. Payments
Tawana may facilitate payments through third-party providers or merchant-configured methods.

Tawana is not a bank or financial institution
Payments may be processed by third parties
Transactions may be delayed, declined, or reversed

Tawana is not responsible for:

Payment provider failures
Chargebacks or disputes
Fraudulent transactions beyond reasonable control

Tawana may introduce wallet, escrow, or payment services (“TawanaPay” or similar). Additional terms will apply where relevant.

7. Fees and Billing
Tawana may charge fees including:

Subscription fees
Transaction or commission fees
Payment processing or service fees

Fees may vary by plan, region, or feature set and may be updated from time to time.

Failure to pay fees may result in:

Suspension of services
Restricted access to features
Termination of account

8. Content and Data
You retain ownership of content you upload (e.g. products, images, shop data).

You grant Tawana a worldwide, non-exclusive, royalty-free licence to:

Host, store, and display your content
Generate previews (e.g. product collages, QR codes)
Distribute content via feeds (e.g. Meta, Google)
Promote your shop within the Platform

You are responsible for ensuring your content is lawful and does not infringe third-party rights.

9. Acceptable Use
You must not use the Platform to:

Violate any laws or regulations
Sell illegal, restricted, or harmful goods
Engage in fraud, deception, or abuse
Upload malicious code or attempt to disrupt the Platform
Bypass platform controls, pricing, or payment systems

10. Marketplace and Platform Evolution
Tawana may introduce marketplace features, including:

Discovery and search across multiple shops
Aggregated checkout or payments
Ratings, reviews, and trust systems

Tawana may also:

Set platform rules or quality standards
Adjust visibility or ranking of shops
Apply commissions on marketplace transactions

11. Third-Party Services
The Platform integrates with third-party services (e.g. payment providers, analytics, social platforms).

These services are governed by their own terms
Tawana is not responsible for their performance or availability

12. Platform Availability
The Platform is provided on an “as is” and “as available” basis.

We do not guarantee:

Continuous uptime
Error-free operation
Availability of all features at all times

13. Disclaimers
To the maximum extent permitted by law, Tawana disclaims all warranties, including:

Fitness for purpose
Accuracy or completeness of content
Reliability of services

14. Limitation of Liability
Tawana shall not be liable for:

Your use of the Platform is at your own risk.

15. Indemnification
You agree to indemnify and hold harmless Tawana from any claims, damages, or liabilities arising from:

Your use of the Platform
Your content
Your violation of these Terms

16. Compliance and Jurisdiction
You agree to comply with all applicable laws, including:

Consumer protection laws
Tax and financial regulations
Data protection and privacy laws

Tawana may restrict access to the Platform where required by law.

17. Suspension and Termination
Tawana may suspend or terminate access to the Platform at any time to:

Protect users and merchants
Prevent fraud or abuse
Ensure legal compliance

Certain provisions will survive termination.

18. Intellectual Property
All Platform software, design, branding, and technology are owned by Tawana or its licensors.

Merchant Terms of Use
The Tawana platform enables merchants to create, manage, and operate online shops.

By creating a shop on Tawana, you agree to these Terms.

1. Nature of Service

Tawana provides tools to build and run an online shop
You are the seller of record for all transactions
You are fully responsible for your business operations

2. Merchant Responsibilities

Provide accurate product descriptions and pricing
Honour all confirmed orders
Comply with applicable laws and regulations
Maintain customer service standards

3. Orders & Fulfilment

You are responsible for order processing and delivery
You must update order status accurately
Failure to fulfil orders may result in penalties or suspension

4. Payments

You may use supported payment providers or your own methods
Tawana may process or facilitate payments where applicable
You are responsible for fees, taxes, and compliance

5. Fees & Subscriptions

Tawana may charge subscription fees or commissions
Fees are subject to change with notice
Failure to pay may result in restricted access

6. Platform Usage

You must not sell prohibited or illegal goods
You must not misuse platform features
You must not attempt to bypass Tawana systems

7. Data & Content

You retain ownership of your product data
You grant Tawana the right to display and distribute your content

Customer Terms of Use
The Tawana platform, accessible via merchant storefronts (e.g. yourshop.tawana.shop), enables customers to browse products and place orders with independent merchants.

By using Tawana storefronts, you agree to these Terms.

1. Nature of Service

You are purchasing directly from a merchant, not Tawana
Tawana provides the technology platform only
Tawana does not own, stock, or ship products

2. Orders

All orders are subject to merchant acceptance
Prices, availability, and delivery terms are set by the merchant
You are responsible for providing accurate order details

3. Payments

Payments may be processed via third-party providers or merchant methods
Tawana does not guarantee payment processing availability
Transactions may be declined or reversed for security reasons

4. Delivery & Fulfilment

Merchants are solely responsible for delivery
Delivery times are estimates unless stated otherwise
Tawana is not responsible for delays or delivery failures

5. Refunds & Returns

Refunds and returns are governed by the merchant’s policy
Tawana may assist in disputes but is not liable for outcomes

6. Acceptable Use

You must not use Tawana for fraudulent activity
You must not abuse merchants or platform features
